User Agreement

These terms and conditions apply to all subscriptions made to Kontax Ultimate Search Pty Ltd (hereafter referred to as "Kontax").

1. Subscription

All payments made either through this web site, by mail or phone, are subject to confirmation and acceptance by Kontax. Where the requested subscription is not available you will be notified by Kontax as soon as possible. Once your account is activated, it is your responsibility to manage all input and updating of data. Kontax reserves the right to restrict and edit content of data base.

2. Refunds

All refund applications will be carefully considered and given at the discretion of the Company Management. Your contract with Kontax is for a period of 12 months and will be due for renewal on the anniversary of your initial application subject to receipt of the appropriate fee by Kontax. You will be given notice in writing by email at least 30 days before the annual renewal date of your contract with us. SMS credits will accumulate with your subscription renewal however unused credits upon failure to renew your subscription will become forfeit.

3. Prices and Payment

For each subscription (Gold or Platinum), you must pay the applicable fee as provided by Kontax. Subscription prices and range of services on the website are subject to change without notice. All subscription fees must be paid and funds cleared before accounts will become activated on the website unless prior credit arrangements have been made with Kontax.

Money Orders or Cheques

Money orders or cheques are to be sent with a copy of your application acceptance email. DO NOT SEND CASH through the post. Money orders and cheques are to be made payable to:

4. Product

Kontax operates an online database designed to facilitate contact principally within the construction industry. The Kontax website will provide and interface between contractors and clients on the next technological level, providing free live email and SMS services through the website. Users will be able to search for, locate the service required and contact the contractor directly via a brief SMS, a more detailed email, or attach a formal job specification.

Services provided to the subscriber are:

	24 hour access to update their advertisement, equipment lists and availability of work.
	Australia wide advertisement via the Kontax website.
	An email and SMS service that will contact them with details and specifications for work from potential clients.
	A more dynamic and flexible method of advertisement, an alternative to existing fixed annual services.
	The choice of two subscriptions, Gold providing advertisements for up to three items or services and Platinum for between four and twelve items or services.

Services provided for the website user:

	A user friendly search tool to find transport, earthmoving plant and equipment and contractors anywhere in Australia.
	Options to search from four categories (Transport, Earthmoving, Contractors or multi search) by location either by drilling down through a map search or by entering a postcode and search radius.
	Detailed search results showing full details of items searched for including availability and options to contact your required service (phone, SMS, email).
	Option to send SMS and email to a specific contractor or all contractors listed in a search result.

5. Your Account

You agree to take responsibility for the safekeeping of your user name and password. You are liable if your user name or password is used by an unauthorised person. You agree to release and indemnify Kontax in connection with any use (whether authorised or unauthorised) of your user name or password. Kontax may suspend or cancel your account at any time without prior notice. Kontax is not party to any contract entered into between an account holder and any person or legal entity introduced to that account holder through the use of the Kontax website.

6. Privacy

Kontax will not reveal your personal information to external organizations. It is our usual practice to collect personal information directly from you. We may occasionally collect personal information from a third party if you have consented or would reasonably expect us to collect the information in this way, for example from publicly available sources such as websites or telephone directories. We do not collect personal information about you if you only browse this website. Your personal information will only be used for the purposes for which you give it to us and for related, internal management purposes.

We do not give information about you to other government agencies, organisations or anyone else unless one of the following applies:

	you have consented
	you would expect us to or we have told you we will
	it is required or authorised by law
	it will prevent or lessen a serious and imminent threat to somebody's life or health or
	the disclosure is reasonably necessary for law enforcement or for the protection of public revenue.

We analyse non-identifiable website traffic data to improve our services. We collect information such as page view numbers, totals and queries that are searched, though not in relation to any individual user. Our Office is bound by the Information Privacy Principles of the Privacy Act 1988.

7. Liability

Kontax is not liable, or responsible for any of the content found on our site and search engine. Our results are not guaranteed to have been manually reviewed and/or approved for all ages for unethical content. Kontax accepts no responsibility with regards to services/contracts acquired via the Kontax website and is in no way liable for any disputes between subscription/account holder and any third party. To the extent permitted by law, Kontax and/or its suppliers exclude all liability for any direct, indirect, punitive, incidental, special, consequential damages, or any damages whatsoever including without limitation, damages for loss of life, data or profits, arising out of or in any way connected with the use or performance of the Kontax website, the delay or inability to use the Kontax website, the provision of or failure to provide information or services obtained through the Kontax website. Kontax and its employees and agents will not be liable in contract or tort (including negligence), equity or on any other basis to you or any other person for any loss, injury or damage arising from or as a consequence of any act or omission by Kontax or any person providing services through the Kontax website.

8. Changes To Terms

Each subscription is governed by the terms and conditions current when the subscription is placed. Kontax may add to, delete or otherwise change these terms and conditions without notice. It is your responsibility to read and understand these terms and conditions each time you renew your subscription.

9. Applicable Law

All subscriptions, and these terms and conditions, are subject to the laws of Queensland, Australia. All offers made, contracts concluded and services provided through the Kontax website shall be deemed to be made and provided in Australia notwithstanding the location of you or any other person, shall be governed exclusively by Australian law, and the Courts of Australia shall have exclusive jurisdiction to determine any such matters involving or alleged to involve Kontax.

All material contained within this website is the copyright of Kontax except where credit is noted to other parties. Permission may be sought in writing from Kontax to publish material from this website and from third parties direct where so noted.
